Buyer Terms and Conditions

These Buyer Terms and Conditions (the “Buyer Terms”) apply to each purchase made through https://www.plantlustbotanicals.com/ (the “Site”). The seller is Plantlust Botanicals LLC (“plantLust,” “we,” “us” or “our”). By submitting an order, you agree to these Buyer Terms.

1. Orders and Acceptance

Your order is an offer to purchase the items identified in the order. An automated order-confirmation email confirms that we received your order but does not accept it. An order is not accepted until plantLust confirms acceptance or ships the ordered items, whichever occurs first. We may refuse, cancel, limit or refund any order or part of an order, including because of suspected fraud, misuse, unauthorized resale, a violation of these Buyer Terms, an error in pricing or product information, product unavailability or an order that appears inappropriate.

You must provide current, complete and accurate order, shipping and payment information. You are responsible for promptly updating information needed to complete your order.

2. Products, Availability and Personal Use

Products are offered for personal use only. You may not resell, transfer, remarket or otherwise distribute products without our prior written consent.

Product availability is not guaranteed. We may revise, limit or discontinue a product at any time. Product descriptions, ingredient information, photographs, dimensions, colors, packaging, availability and pricing may contain inadvertent errors or omissions and may be corrected at any time. Product photographs, colors and packaging may vary from the items you receive. We may limit quantities available for purchase.

3. Prices, Payment and Taxes

Prices are stated in U.S. dollars unless expressly stated otherwise. Prices, promotions and product availability may change without notice. The price stated when you submit an order is subject to confirmation at acceptance. If we identify a pricing or product-information error, we may cancel the affected order and refund amounts paid for it.

Unless otherwise agreed in writing, payment must be received before we accept an order. You authorize the payment method submitted with your order to be charged for the total amount due, including applicable shipping, handling and taxes.

Shipping and handling charges, if applicable, will be shown during checkout or on the invoice. You are responsible for applicable sales, use and similar taxes unless you provide a valid exemption certificate before order acceptance.

4. Shipping, Delivery and Risk of Loss

Available shipping options will be presented at checkout or otherwise communicated to you. Standard orders are ordinarily processed within 3–5 business days, but processing times are estimates and are not guaranteed. Made-to-order or scheduled products may require a longer processing period. For example, custom soap may require 7–8 weeks, seasonal boxes are shipped around each equinox and solstice and Plant of the Year offerings are ordinarily sent toward the end of the year. Delivery dates are estimates and are not guaranteed. plantLust is not responsible for a delay caused by a carrier, an inaccurate address, an event outside our reasonable control or your failure to provide information needed to ship the order.

You are responsible for providing a complete and accurate shipping address. Contact us promptly at plantLustBotanicals@gmail.com if you need to change or correct an address. We cannot guarantee that a change request can be made after an order has entered processing or shipped, and we are not responsible for a delay, loss or additional shipping cost caused by an inaccurate or incomplete address.

Risk of loss passes to you when the order is delivered to the carrier for shipment. If you select or arrange a carrier, you are responsible for loss or damage in transit. If plantLust selects the carrier, we will address a reported loss or damage in transit in accordance with applicable law and the carrier’s process.

plantLust is not responsible for a delay or failure to perform caused by an event outside its reasonable control, including carrier disruption, severe weather, natural disaster, supply interruption, labor dispute, governmental action, public-health emergency, power or telecommunications failure or another event of similar nature. We will use reasonable efforts to address the affected order when the event ends.

5. Returns, Exchanges and Refunds

We stand behind every product we sell. If you are not completely satisfied with your plantLust Botanicals purchase, you may return it for a replacement or refund.

To be eligible for a return or exchange, the request must be made within 15 days after delivery and you must provide a receipt. Email plantLustBotanicals@gmail.com to initiate a return or exchange. Please include your order number and a description of the request.

You may request cancellation or a change to an order before it enters processing. Once an order has entered processing or shipped, plantLust may be unable to cancel or change it.

Approved refunds will be credited to the original form of payment, less shipping costs. You are responsible for return-shipping costs.

Inspect your order promptly after delivery. A returned product must be unused, unopened and in its original packaging. If an order is damaged, defective or incorrect, contact plantLustBotanicals@gmail.com within 7 days after delivery and retain the original packaging. plantLust may request photographs or other documentation reasonably needed to evaluate the claim and will provide the applicable return, replacement or refund instructions.

plantLust will issue an approved replacement or refund within 5 business days after receiving the return or approving the claim.

6. Product Information and Personal Responsibility

Use products only as directed. Review each product’s label, directions, ingredients and warnings before use. For a product intended for topical use, patch test before broader use if the product label or product page directs you to do so. Keep products out of reach of children. You are responsible for determining whether a product is appropriate for you. Stop using a product if you experience irritation or another adverse reaction and seek appropriate professional advice.

Additional product-specific cautions, directions and ingredient information appear on the product label and product page and form part of the directions for use.

To the fullest extent permitted by law, plantLust is not responsible for an allergic reaction, sensitivity or other adverse effect arising from your failure to review or follow the product label, ingredients, directions or warnings. This provision does not limit liability that cannot lawfully be excluded or limited.

Product information on the Site is provided for general informational and shopping purposes only. Nothing on the Site or in these Buyer Terms constitutes medical advice or is a substitute for advice from a qualified health-care professional.

plantLust products are not intended to diagnose, cure, mitigate, treat or prevent any disease or to affect the structure or any function of the body. These are the uses that generally cause an article to be regulated as a drug under the Federal Food, Drug, and Cosmetic Act.

7. Disclaimer of Warranties

To the fullest extent permitted by law, products are provided on an “as is” and “as available” basis, except for warranties that cannot lawfully be disclaimed. plantLust disclaims implied warranties of merchantability, fitness for a particular purpose, title and noninfringement.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law.

8. Limitation of Liability

To the fullest extent permitted by law, plantLust and its members, managers, employees, contractors, licensors and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages arising from or related to an order or product, even if advised of the possibility of those damages.

To the fullest extent permitted by law, plantLust’s total liability for a claim arising from an order or product will not exceed the amount you paid for the product giving rise to the claim.

Nothing in these Buyer Terms excludes or limits liability that cannot lawfully be excluded or limited.

9. Governing Law and Venue

These Buyer Terms are governed by the laws of the State of Vermont, without regard to conflict-of-law principles. Any dispute arising from or relating to these Buyer Terms, an order or a product must be brought exclusively in the state or federal courts located in Vermont, and you consent to their jurisdiction and venue.

10. Relationship to Other Policies

The Website Terms of Use and Privacy Policy apply to your use of the Site. If there is a conflict between these Buyer Terms and the Website Terms of Use, these Buyer Terms control as to the purchase.

11. Changes to These Buyer Terms

We may update these Buyer Terms from time to time. The updated Buyer Terms will apply to purchases made after they are posted on the Site, unless otherwise stated.

12. General

These Buyer Terms, together with the order confirmation, Website Terms of Use and Privacy Policy, are the entire agreement between you and plantLust regarding that order. If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Buyer Terms without our prior written consent.
